You are on the radio. Your song has millions of plays. People message you “congrats, you are killing it!”. And you look at your bank account… and there is nothing. Sound familiar? You are not crazy, and you are not necessarily being robbed. You are very likely inside something called recoupment, and almost nobody explains it plainly. Let us fix that.
💸 What is recoupment, and why do you see no money?
Recoupment is a fancy word for something simple: the label recovers the money it lent you before you see a single cent of royalties.
Think of it this way. The label gave you an advance (a loan), and also paid for things: the studio, the video, the producer, promotion, maybe even the food at the sessions. All of that goes onto an account in your name. Your royalties do not go into your pocket first: they go to pay off that account. Only when the account reaches zero do you actually start getting paid.
That is why you can be played a lot and still see zero. It is not that you are not generating money: it is that the money is paying off a debt you may not even remember exists.
⚠️ What is cross-collateralization (and why is it dangerous)?
Here comes the part that sinks many artists. Cross-collateralization means the label can put the debts of several projects into a single bag.
Simple example: your first album did not recoup, but your second album is a hit. With cross-collateralization, the money from the successful album first pays off the debt of the one that flopped. The result: your success does not pay you, it pays your past.
It is like having two credit cards and the bank using your good salary to cover the hole in the old card before giving you anything. Legal, common, and often hidden in a single sentence of the contract.
📅 How do I estimate when I start getting paid?
There is no magic formula, but there is a logical way to estimate it. You need three numbers from your own contract and statements:
- How much was advanced to you / spent in your name (the size of the debt).
- Your royalty rate (what percentage of what comes in is yours).
- How much your music is generating per period (look at your recent statements).
With those you can do a rough calculation: how far you are from your share of royalties paying off the debt. If you generate little and the debt is large, the date is far away. If you generate a lot, it gets closer. Careful: this is an estimate to orient you, not a promise. The real numbers are in your contract and your statements, and only a professional can confirm them.
⚠️ What are the most dangerous red flags?
When you read your contract (or somebody reads it for you), look for these three:
- Perpetuity. The label holding the rights “forever” or “for the life of the copyright”. That can mean you never get control of your music back.
- Auto-renewal with a notice window. The contract renews itself unless you give notice that you want out within a small, specific window of time. Miss that window and you are tied for another term without realising it.
- The 360 clause. The label takes not just part of your music but a slice of your shows, your merch, your social media, your brand deals. Everything. Check which “revenues” fall inside the definition.
None of these are illegal. Many are normal. But you have the right to know they are there before they decide your life for ten years.
